Language of Consent
PIPEDA-2005-296
Date: March 1, 2005
Summary: OPC recommended that banks revise its application forms to include clear disclosures aligned with federal guidance. Specifically, forms should state that (1) customers cannot withdraw consent for the bank’s disclosure of credit data to credit bureaus, (2) the purpose of ongoing disclosure is to maintain the integrity of the credit granting system, and (3) the collection of name, address, date of birth, and occupation is legally required. These additions are necessary to meet the meaningful consent standard under Section 6.1 and Clause 4.3.2 of Schedule 1 to PIPEDA.
